How a Typical Case is Handled

This is how a typical case would be handled from start to finish in the criminal law courts.

Two of Lou Shelling’s major specialties are spousal assault and driving while prohibited charges but he is fully qualified to handle all criminal matters.

All cases would proceed in roughly the same manner.

  1. There will be an initial interview, which will cost you nothing. At this time you will be given an overview of the various options available and the fees involved.
  2. Alter this, if you wish to engage my services you will be required to provide me with a retainer fee, which will be a portion (usually 25%) of the ultimate fee.
  3. Once the retainer is received, I will be able to appear on your behalf at the initial appearance date. At that time, I will obtain copies of what we call disclosure documents, which will contain an outline of the prosecution case against you. A copy will be made and provided to you, and a further appointment made to discuss this information before the next court date.
  4. At that appointment, you will advise me of your position vis a vis the disclosure, and I will give you my opinion as to how to proceed. This advice could range from trying to work out a plea bargain with the prosecution to setting a date for trial. You will then instruct me as to what you wish me to do, and I will act accordingly.
  5. You will be kept advised of my conversations with crown counsel. Nothing will be finalized without your consent.
  6. This process may take a number of further appearances, all of which I can make for you.
  7. In the end, there will be a discussion of whether the case can be concluded without a trial, and in a manner agreeable to you.
  8. If all else fails a trial date will be set, usually 6-9 months in the future.
  9. At the trial, I will cross-examine the crown witnesses, call any defence witnesses (including yourself), and make submissions to the judge on your behalf.
